All of the conduct described herein occurred within the County of St. Louis, State of Minnesota, unless otherwise noted. On November 4, 2025, at approximately 4:58 AM, Officer Johansen with the Duluth Police Department responded to the report of a medical assault at the Damiano Center, 206 West 4th Street in Duluth, St. Louis County, Minnesota. The reporting party was staff from the Damiano calling on behalf of a male born in 2001, hereinafter referred to as the victim, who had been assaulted while sleeping.
Video footage revealed the identity of the suspect as LARRY TATE JR, [DOB redacted], hereinafter referred to as the Defendant. Video shows the Victim [NAME REDACTED] in the front door alcove. Another man, later identified as C. J. W. Year of birth 1991, is seen walking up into the alcove and appears to be changing clothes. The Defendant is then seen walking up the stairs to where the Victim [NAME REDACTED]. The Defendant begins to kick the Victim [NAME REDACTED]. The Defendant was wearing a medical boot on his foot.
In a subsequent Mirandized statement, the Defendant admitted to kicking the Victim [NAME REDACTED]. He explained that 48 hours ago, his cell phone had been stolen. The Defendant said that he pinged the phone to look for it and it pinged to the Victim. The Victim required transportation by Mayo ambulance to Essentia Emergency Room. There, the Victim was unable to remain conscious due to his injuries. In addition to the loss of consciousness, the Victim had an extremely swollen left side of his face as well as blood in his mouth and on his face.
