On May 26, 2021, Robbinsdale police received a report from Victim that she had been sexually assaulted a day earlier by an individual she knew as "David Griffin" whom she had met through Facebook. Investigators later identified "David Griffin" as EUGENE DAVID GRIFFIN ([DOB redacted]) ("Defendant" herein). The investigation revealed that, on the evening of May 25, 2021, Victim met up with Defendant at a home in the area of 38th Avenue North and Quail Avenue North, in Robbinsdale, Hennepin County, Minnesota, where Defendant was under house arrest.
Victim told police that Defendant had invited her over to smoke marijuana. Victim went to the residence, and smoked marijuana outside of the residence before Defendant invited Victim inside. Inside, Victim and Defendant smoked more marijuana before Victim asked Defendant how he could help her get home. Defendant told Victim that his brother could give her a ride home. At this point, Defendant began touching Victim and asked Victim if she could "take [Defendant's] dick out of the pawn shop," and that it had not been "used in a while." Defendant asked Victim to perform oral sex on him and Victim refused.
Defendant asked to engage in vaginal intercourse and Victim refused. Defendant then tried to take Victim's pants off and Victim resisted Defendant's advances. At one point, Defendant choked Victim to the point of unconsciousness. When she awoke, she was shaking and Defendant had Victim in his arms. Defendant then held Victim down and sat on her legs while he pulled her pants off. Defendant then put his penis inside her vagina. Victim reported that she tried to push Defendant off and told Defendant "no" when this occurred.
Defendant then ejaculated on Victim's right leg and thigh and the shirt she was wearing. Victim also reported that Defendant bit her above one of her breasts and on the top of her thigh. Victim reported that several of her clothes were ripped during the assault. Victim obtained a sexual assault medical examination on May 27, 2021. During the examination, Victim described how Defendant used his left forearm to "choke [Victim] out" and that he attempted to choke her multiple times but was only successful at strangling her to the point of unconsciousness once.
Victim reported that Defendant told her that if she did not listen to him, he was going to knock her out and leave her there until the morning. A bruise was found on Victim's thigh and Victim indicated that is where Defendant bit her. Victim told the medical provider that she had not engaged in hygiene activities since the assault. DNA analysis was performed on various pieces of evidence collected during the sexual assault examination. Among the items tested were swabbings from Victim's neck, bilateral breast, belly button, and right outer thigh.
