That on or about November 28, 2025, at approximately 1:09 A.M., Trooper Strogoteanu of the Minnesota State Patrol responded to a one-vehicle accident on northbound Highway 252 at Humboldt Avenue N, in the city of Brooklyn Park, Hennepin County. The suspect vehicle bore Minnesota license number HJW-304 and was driven by BRYAN ALEJANDRO CRUZ GUTIERREZ, Defendant herein. Trooper Strogonteanu detected the overwhelming odor of consumed alcohol coming from Defendant's breath and noted Defendant's eyes were glossy and watery.

Defendant admitted to consuming alcohol prior to driving. Due to a language barrier, only the HGN test was administered. This test revealed several clues of impairment.
