GREGORY ALLEN DIMARTINO, [DOB REDACTED], has the following qualified prior impaired driving convictions within the past ten years. ••-CR-••-••••, Traffic DWI, misdemeanor conviction 7/10/2018 ••-CR-••-••••, Traffic DWI, misdemeanor per 609.13, conviction 1/30/2020 ••-CR-••-••••, Traffic DWI, gross misdemeanor conviction 2/13/2023 On December 10, 2025, at approximately 9:11 P.M., Officer Morales was on patrol and stopped at a red light at the intersection of McKnight Road North and Minnehaha Avenue East, Maplewood, County of Ramsey.
Officer Morales observed a silver Kia drive eastbound on Minnehaha Avenue, and turn left at a red light. The vehicle pulled into the parking lot of Sarrack’s Wines and Spirits, Stillwater Road. Officer Morales activated emergency lights, stopped the vehicle, made contact with the driver, and advised him of the reason for the stop (failure to stop at a red light). The driver-later identified as DIMARTINO-said he knew he ran the red light. He said he did not have a driver’s license and did not have insurance.
DIMARTINO said he was driving his dad’s vehicle because he wanted to get food. DIMARTINO’s driver’s license status was Cancelled-Inimical to Public Safety. DIMARTINO was arrested. DIMARTINO had watery eyes, slurred speech, and an odor of alcohol from his mouth. After a Miranda advisory, DIMARTINO spoke to Officer Morales. He admitted knowing his driver’s license was cancelled. He said he wanted to get food and was driving to Taco Bell. DIMARTINO said he pulled into the Sarrack’s parking lot because Officer Morales put on his emergency lights.
Upon inquiry, DIMARTINO said he took two “99 shooters” two hours before the stop. DIMARTINO refused a PBT. He said, “I already know I’m going to blow over the limit.” DIMARTINO was transported to the police department. He was asked to perform field sobriety tests, but declined. The Breath Test Advisory was read to DIMARTINO at 9:58 P.M., signed by Officer Morales at 10:20 P.M. DIMARTINO was given time to consult with an attorney. After getting legal counsel, DIMARTINO refused to take the DMT test and refused a breath sample.
