The deputy initiated a traffic stop and made contact with the driver, who was confirmed to be the defendant. While speaking with the defendant the deputy observed signs of the defendant being impaired, including bloodshot watery eyes, slurred speech and odor of alcohol. The defendant admitted consuming alcohol and could not articulate how much she had to drink. The Horizontal Gaze Nystagmus test was performed and showed signs of impairment. A preliminary breath test by the defendant had a.112 result.
The defendant was placed under arrest. After attempts to have her vehicle driven from the scene by a sober driver were unsuccessful, a tow of the vehicle was arranged. An inventory search of the vehicle resulted in the discovery of a baggie containing a white powdery substance in the center console of the vehicle, along with other paraphernalia used to consume controlled substances. The substance field tested positive for the presence of cocaine and weighed 1.15 grams. The defendant was read the breath test advisory and agreed to provide a breath sample.
