Probable Cause
The assault took place at 379 Baldwin, Elk River, Sherburne County, Minnesota. Victim reported a verbal argument with a minimal physical component wherein Defendant caused fear in Victim due to threats to kill her and even her children. During this argument, Defendant referenced being able to get a weapon. Victim reported being fearful that Defendant might act in accordance with what he threatened. Victim wanted to call the police during this time but Defendant would then again threaten death. She did try after Defendant left the home but struggled to connect as she is a spanish speaker.
Victim indicated that she and Defendant have been in a romantic relationship for about two years and that they are living together. She described how Defendant is an abuser and that he gets very controlling and jealous. She reported that he routinely threatens to harm or even kill her in the past. She is afraid that he will act accordingly at some point. On 3/23/2026, Victim minimized the physical component of the assault and also reported not wanting Defendant prosecuted as they went to church and reconciled.
Defendant was arrested and declined to speak to the police. PLEASE TAKE NOTICE: Pursuant to Minn.
