The deputy initiated a traffic stop and made contact with the driver and sole occupant of the vehicle, eventually identified as KITANNA HOPE MARTINEZ [DOB REDACTED], defendant herein. The deputy was able to confirm that the defendant had two warrants for her arrest. The defendant was placed under arrest pursuant to the warrants. Due to observing numerous needles in the vehicle and a tourniquet, consistent with injecting controlled substances, along with prior history of the defendant using fentanyl, the deputy warned the defendant about additional charges if she was found to be in possession of controlled substances when brought into the jail.
The defendant denied having anything in her possession. The defendant was transported to the Sherburne County jail and while changing into jail clothing a baggie containing a small amount of a tan powdery substance was discovered on the defendant's person. The defendant indicated she had forgotten it was in her bra. The substance field tested positive for the presence of fentanyl and weighed 1.04 grams with packaging. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
