M., a Winona Police Officer (“Officer”) was dispatched to Winona Health Intensive Care Unit (ICU), in the City and County of Winona, Minnesota, to collect a suspected controlled substance that was located on a patient. When Officer arrived at ICU, he met with the reporting party (Witness). Witness reported he was changing out his patient, Eric John Corey, [DOB REDACTED] (“Defendant”). Witness stated he located a black nylon container in Defendant’s pants’ pocket. Witness opened the container to see what was inside and located two plastic baggies with a white rock-like substance inside them.
Witness believed the substances were controlled substances. Witness reported Defendant was lethargic due to his medical state and did not believe he could provide a statement to Officer. Officer took custody of the container and brought it back to the law enforcement center. Officer field tested the white substances within both baggies. The first baggie weighed 3.6 grams and field tested positive for cocaine. The second baggie weighed 27.4 grams and field tested positive for cocaine. PLEASE TAKE NOTICE: Pursuant to Minn.
