That on October 25, 2025, at approximately 0222 hours, Trooper A. F., Minnesota State Patrol, responded to a vehicle (MN Lic.#HZB542, 2007 Nissan Altima) that had spun out in the Lowry Tunnel on I94, Minneapolis, Hennepin County, Minnesota. Upon arrival, the driver of the crashed vehicle, Defendant herein, Elijah Joseph Proost, [DOB redacted], approached Trp. A. F. And stated that he had spun out and that no one was hurt. Defendant smelled of an alcoholic beverage, had bloodshot/watery eyes, and admitted consuming one beer and later to drinking three beers.
Due to the accidents location Defendant was given a preliminary breath test (PBT) which showed his alcohol level to be 0.120 after which he was transported to Hennepin County Medical Center where other field sobriety tests could be safely completed. Defendant showed multiple clues of impairment in the Horizontal Gaze Nystagmus (HGN) and the Walk-and-Turn tests and was placed under arrest. A warrant was obtained for Defendant’s blood/urine and at 0348 hours, Defendant agreed to have a registered nurse draw a voluntary, evidentiary blood sample pursuant to the warrant and for which later testing by the Minnesota Bureau of Criminal Apprehension showed his alcohol level to be 0.115. At the time of the listed driving Defendant was 18 years of age.
