Officer Lunt later photographed the scissors and a broken mug that was lying on the floor. While Officer Lunt spoke with Victim A, Officer Schuweiler spoke with the defendant. The defendant said she was at the house, drinking with her sisters, and Victim A made a comment to one of her sisters which caused the defendant to confront Victim A. The defendant said Victim A had thrown a cup (ceramic mug) at her, demonstrating the throwing of a cup as someone tossing the liquid out of it. The defendant later said the cup was thrown at her, and she picked it up and threw it back at Victim A. The defendant said she did not see what her sisters did as her eyes had the liquid from the cup in them, and then said Victim A hit her.
Officers arrested the defendant and STPEHANIE MARTINEZ. The defendant provided a preliminary breath 2 50-CR-26-4 Filed in District Court State of Minnesota 1/2/2026 test of 0.18 BAC on scene, and a 0.19 BAC at the jail. STEPHANIE MARTINEZ provided a preliminary breath test sample at the jail, resulting in a reading of 0.253 BAC. On January 2, 2026, Austin Police Department Detective Brant Strouf spoke with Witness 1 by telephone to get clarification regarding the incident that occurred the previous day.
Witness 1 said he was in an adjacent room when he heard the fracas break out. He went into the kitchen where he saw Witness 2 (an adult woman) holding Victim A’s hair. Witness 1 said STEPHANIE MARTINEZ had a pair of scissors and first cut Victim A’s hair and then raised the scissors up in a “knife position” over Victim A as though she was going to stab him. Witness 1 said he grabbed STEPHANIE MARTINEZ to prevent her from stabbing Victim A and was able to wrestle the scissors away from her despite her tight grip she had on them.
