Probable Cause
On 03/22/26, Ofc. Mitchell was dispatched to a delayed domestic report. The Complainant indicated that on 02/20/26 her estranged husband physically assaulted her in her home located in Dilworth, Clay County, MN. The Complainant was identified to be C. L. K., hereinafter referred to as Victim. Victim's estranged husband was identified to be JAMES STEPHAN MARIA KELLNER [DOB REDACTED], hereinafter referred to as Defendant. Defendant told the Victim that he wanted to own half of her cleaning business.
During the argument the Defendant threw a bottle against the wall. At this point, the Victim opened the door to her apartment and told the Defendant to leave. Instead of leaving the Defendant came up behind the Victim, put his hand over her and forced the door shut. Victim tried to open the door but the Defendant forced the door shut, causing her left hand to get smashed between the door and the frame. Victim then stated "owe you're hurting me." Defendant then placed his hand on the Victim's neck and pushed her into a chair sitting in the corner of the dining room.
Victim stated that while the Defendant's hand was on her neck she did not resist him and kept walking backward so that he wouldn't choke her. She was fearful during the incident that the Defendant could easily apply more pressure on her throat with his hand when it was on her neck. Victim also indicated that her hand that was slammed in the door was painful, swelling, and eventually bruised. She told the Defendant to leave multiple times, and he eventually left. Victim [NAME REDACTED] injuries to her hand that she took from the incident on 02/20/26. Defendant has a prior conviction for felony Strangulation on 02/26/20 in casefile 14-CR-19-560. **This is a DV Court matter for scheduling purposes.
