On or about November 13, 2025 at approximately 3:55 PM, Officer Caruso of the Blaine Police Department responded to a reported two-vehicle personal injury accident in the area of 109th Avenue NE and Sunset Avenue NE in the City of Blaine, Anoka County, Minnesota. The officer identified the involved drivers as K. O. And GARY ALAN BISER [DOB REDACTED], Defendant herein. The officer learned that both parties were traveling on 109th Avenue NE, K. O. Traveling eastbound while Defendant was traveling westbound, when the vehicles collided head-on.
The officer spoke with two witnesses, both whom advised that they observed Defendant traveling westbound in the eastbound lanes prior to the collision. K. O. Advised that Defendant had drifted into the westbound lane while in the curve on 109th Avenue NE and K. O. Was unable to avoid the collision. K. O. Complained of hand pain and suffered a 1-2 inch cut on his right hand as a result of the collision. Officer Titus made contact with Defendant, who was in the driver's seat of his vehicle. Defendant was awake, but not responding appropriately to first responders as he was looking down and mumbling.
After Defendant had been loaded into an Allina ambulance, Defendant began talking more. The officer observed that Defendant's speech was incredibly slurred and incoherent. The officer further observed that Defendant's eyes were watery, his movements were slow, and he was emotionally unstable. When asked about alcohol consumption, Defendant became upset. Officers captured a manual PBT of 0.273. Defendant was transported to Mercy Hospital. Law enforcement obtained a search warrant for a fluid sample from Defendant.
The search warrant was executed upon Defendant's person in the form of a blood draw at 6:02 PM. BCA lab results are currently pending. A review of Defendant's driver's record shows that his driver's license is subject to an alcohol and drug restriction. A review of Defendant's criminal history does not show any prior qualified impaired driving convictions within the last ten years.
