On March 12, 2026 at approximately 12:24 A.M., Officer Birkner was on routine patrol monitoring traffic on northbound Ferry Street, in the City of Anoka, County of Anoka, State of Minnesota, when he ran a routine check on a vehicle, MN license TJZ782, that passed by his squad. Officer Birkner observed the driver to be a male, however the license plate check revealed that a 51 year old female was the registered owner. Through his inquiry, Officer Birkner learned that a citation was recently issued to SPENCER CHAMUKE EGERE, [DOB REDACTED], the defendant herein, while driving the same vehicle.
Officer Birkner viewed a DVS of the defendant and observed that it was an exact match to the driver. Officer Birkner also learned that the defendant’s driver’s license status was ID only, indicating he did not have a valid driver’s license. Officer Birkner initiated a traffic stop and verbally identified the driver as the defendant. The defendant confirmed that he knew he didn’t have a valid driver’s license. In speaking with the defendant, Officer Birkner detected an overwhelming odor of raw marijuana and observed a clear plastic baggie containing a green leafy substance, which later NIK tested positive for marijuana, on the floorboard of the vehicle.
The marijuana had been removed from the original packaging that it was sold in, and the seal was broken, with contents missing. The defendant was asked to exit the vehicle and was further asked if there was any additional marijuana inside the vehicle, to which the defendant responded there was. Officer Birkner asked again, and the defendant stated there wasn’t. Officers conducted a search of the vehicle and located multiple marijuana pipes, a scale and multiple baggies of marijuana. Officers also located a backpack on the rear passenger seat which contained Smith and Wesson.40 pistol, with a serial number of FYN0454, which came back stolen out of Kansas City.
A routine record check revealed that the defendant does not have a permit to carry. The above facts constitute the Complainant’s basis for believing that the above-named defendant on the 12th day of March 2026, in the City of Anoka, County of Anoka, State of Minnesota, there did commit the above-named offense(s).
