On September 30, 2009, Byron Clarence Rush [DOB REDACTED] herein the Defendant was adjudicated delinquent for Aggravated Criminal Sexual Abuse in Illinois court case number 07JD223. Defendant was required to register in Minnesota as a predatory offender in accordance with Minnesota Statute Section 243.166. His registration period is for a lifetime. On 04/21/2025, Defendant filed a Change of Information Form registering himself as homeless in Rochester, Olmsted County, Minnesota and was staying at the Southeast Regional Crisis Center (SERCC) in Rochester.
Detective Burdick of the Rochester Police Department learned that a person could stay at SERCC for only 10 days. Before registering as homeless, Defendant’s address provided to probation was 3718 18th Avenue NW #6, Rochester, Olmsted County, Minnesota. This address was never registered with the Minnesota Bureau of Criminal Apprehension (the BCA). On 5/15/2025, Detective Burdick called Defendant's two listed telephone numbers and could not reach Defendant. Since 04/21/2025, Defendant filed no other changes of information and have not filed weekly homeless check-ins as was required by the statute.
Defendant is currently non-compliant with his predatory offender registration duties and his whereabouts are unknown. The state requests a complaint warrant to be issued for his arrest.
