Officer Hopps confirmed the registered owner, later identified as BRANDON JAY HARRINGTON, [DOB redacted], the defendant herein, had a canceled – inimical to public safety status on his license. Officer Hopps observed the vehicle turn north on Evans St from 193rd Ave and followed the vehicle. Officer Hopps located the vehicle parked near Salvation Army with no one inside the vehicle. Officer Hopps radioed his partner Officer Bownes and advised him the location of the vehicle. While stationed nearby, Officer Hopps observed the defendant wearing a dark/green color sweatshirt appear to be moving from the rear of the vehicle to the front driver’s seat, occasionally moving along the passenger side where he would lose sight of the defendant.
Officer Bownes observed the male and stated he appeared to be the defendant. Officer Bownes observed a suspended object from the rearview mirror. After approximately 30 minutes, Officer Bownes observed the defendant driving South towards him and Officer Hopps made visual contact with the vehicle. Officer Hopps also observed a suspended object from the rearview mirror. Officer Hopps conducted a traffic stop of the vehicle in the Northbound Liquor parking lot in Elk River, Sherburne County, MN. Officer Hopps requested the defendant, driving the vehicle, exit the vehicle.
Officer Hopps placed him in custody for DAC‐IPS. After placing him in custody, Officer Hopps conducted an inventory search of his vehicle and located drug paraphernalia and drugs. Officer Hopps conducted a roadside test of the drugs located in the vehicle and confirmed with Nartec Meth‐1 Test that the substances showed a strong positive hit of methamphetamine. The substances were seized and placed in evidence. PLEASE TAKE NOTICE: Pursuant to Minn.
