The Complainant having reviewed the applicable reports believes the following facts to be true: On January 1, 2026, officers were dispatched to [ADDRESS REDACTED] in Saint Paul, Ramsey County. The caller reported a man trying to get into a vehicle for the second time that afternoon. The man was also reported to be in the caller's backyard. The man was described as being six foot three inches, thin, wearing a dark grey hooded jacket and black pants. Officers located a man fitting the description provided on Hazel Street.
The man provided the name Nick Colby to officers but would not provide a date of birth. As officers were speaking with the defendant, they realized that he was Nicholas Allen VINAR [DOB REDACTED], the defendant herein. Officers recognized him from a previous call. During that call the officers checked the defendant's photo. There was an active felony warrant for the defendant's arrest. Officers told the defendant he was under arrest for his warrant. The defendant tensed his body and refused to put his arms behind his back.
Officers attempted to take the defendant to the ground. He was on his knees and attempting to stand up. He continued to clench his body and refuse to put his arms behind his back. At one point he tried to grab an officer's wrist. The officer felt the defendant's mouth on his forearm and believed the defendant was going to bite him. Officers used ASR spray to gain the defendant's compliance and were able to handcuff him.
