The Complainant having reviewed the applicable reports believes the following facts to be true: On December 25, 2024 at approximately 11:26 P.M. Metro Transit police observed a male, later identified as Hector Adriano Garcia, [DOB REDACTED], defendant herein, on a train at the Snelling station located in the city of St. Paul, Ramsey County, Minnesota, with tin foil that appeared to have burnt residue on it. Based on the officer's training and experience, defendant was in possession of a controlled substance on the train.
Officers approached defendant at the Victory station and identified him. A check revealed he was on the active trespass list since 12/7/24 for a thirty day period. Since officers had four previous incidents with him violating train policies in 2024, he was arrested for trespass. In a search incident to arrest, officers located a glass pipe with residue and two folded pieces of paper containing a purple powdery substance in his front pants pocket. The substances was collected and sent to the BCA for analysis.
The BCA found that the weight of the powdery substance was.08g and the substance was identified as fentanyl, a schedule I/II controlled substance. Given the danger fentanyl poses to public safety on a public train and defendant's repeated violations of metro transit's rules, the state requests a complaint and warrant.
