Your Complainant is an Officer with the Elk River Police Department, and in such capacity makes this Complaint based upon the reports of Officer Nicholas Albert, whom your Complainant believes to be truthful and reliable. On October 19, 2025, at approximately 1:57 A.M., Officer Nicholas Albert of the Elk River Police Department was on duty traveling southbound in the area of [ADDRESS REDACTED] NW, in the City of Elk River, County of Sherburne, State of Minnesota. Officer Albert observed a motor vehicle traveling southbound ahead of his squad car at a speed above the posted speed limit of 30 mph.
Using radar, Officer Albert obtained a speed reading of 40 mph for the suspect vehicle. Officer Albert executed a stop of the vehicle and identified the driver as the defendant herein DAVID ANTHONY POSTERICK, [DOB redacted]. Officer Albert conducted a computer check on the defendant and learned the defendant had a restriction on his driver’s license requiring ignition interlock. Officer Albert observed the vehicle was not equipped with an ignition interlock device. The defendant stated that he was borrowing the vehicle, Minnesota license plate [PLATE REDACTED], from the registered owner.
The defendant stated that he was aware he needed to have an ignition interlock device. This Complaint is further based upon a report from the Minnesota Department of Public Safety indicating the defendant has a restriction on his driver’s license requiring an ignition interlock device. The above facts constitute the Complainant’s basis for believing that the above-named defendant, on the 19th day of October 2025, in the City of Elk River, County of Sherburne, State of Minnesota, committed the above- named offense(s).
