On 03/01/2026, someone cut the chain link for the front gate. Surveillance seemed to show David Grant Piehl Marquardt [DOB REDACTED], Defendant hereafter, having arrived in a red truck, using a tool to do the cutting. Defendant opens the gate and props it open with the tool, then drives his truck inside. Defendant is known as he used to lease lot C43. Defendant has previously expressed interest in the water fountain on lot C43, but which was left to the new lease owners. The fountain was discovered to have gone missing.
Value of the fountain is approximately $1,200. Also learned was that someone had entered the gazebo on lot C43 and possibly opened a cabinet inside, leaving the cabinet door open. The value of the chain link cut was estimated to be $15 and the value of the broken hasp found on the ground outside the shed door was estimated to be $10. A comparison of Defendant's DVS photograph with the person on surveillance seemed to match. It was also learned that Defendant has a red Chevy truck registered to him.
Defendant, when called by law enforcement, admitted to entering the property on 03/01/2026. He also admitted to entering the gazebo and taking a rake and shovel from inside the shed. H e claimed to have left behind when his lease ended ‐ three or four years ago. He denied messing with the lock for the shed, stating that it was already on the ground. He similarly denied cutting the chain securing the front gate, but his actually doing so was captured on video. He also denied taking the fountain indicating that it was too heavy.
When pressed, he indicated that he desires the bird bath, not the fountain, which is contradictory from what others reported. The park has been closed since 10/31/2025 with access limited to only a couple key holders and no indication of anyone being on the property prior to Defendant entering on 03/01. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
