When asked if he was with Way on the day of the shooting, Say said Way went somewhere and returned. Say claimed he was doing dishes and didn’t see what happened. 2 62-CR-26-2404 Filed in District Court State of Minnesota 4/9/2026 When told surveillance video showed him next to the car at the time of the shooting, Say said there were three people in the car – Way was in the front passenger seat. Say told Way to give him the gun and that what Way was doing wasn’t good. Say said he tried to grab the gun from Way when everything just exploded.
Say took the gun and put it away in a crossbody bag in the bedroom downstairs. Investigators showed Say a photo of the gun recovered from the basement at [ADDRESS REDACTED], and Say agreed it was the gun he took from Way. When asked if he knew the police were coming when he hid the gun, Say admitted he knew the police would come. Say said he put the gun away because he didn’t know whether the police would know there was a gun. Say said he was afraid Way might fire at somebody else. Say admitted he didn’t tell police where the gun was when they arrived.
NS later told an investigator that Way shot him. NS denied that Way and Say were struggling over the gun when he was shot.
