On 11/01/25 at approximately 1:11 A.M., Officer Wagner was on routine patrol when he observed a Chevy Equinox, MN lic. RMK083, cross over the lane line and the fog line in the area of I94 and 53rd Av N, in Brooklyn Center, Hennepin County, Minnesota. Officer Wagner initiated a traffic stop and identified the driver of the Chevy as Donnie Ray Wallace, Jr., [DOB REDACTED], the defendant herein. In speaking with the defendant, Officer Wagner noted he had bloodshot watery eyes and detected an odor of an alcoholic beverage coming from him.
The defendant stated that he wasn’t paying attention, was looking inside the vehicle, and admitted that he had two drinks at a bar in Minneapolis. The defendant was asked to perform a series of field sobriety tests, which he performed poorly on, displaying poor balance, coordination, and cognitive functioning. The defendant also submitted to a PBT, which revealed an alcohol concentration of.196, all of which led Officer Wagner to conclude that the defendant was under the influence of alcohol. The defendant was placed under arrest for DWI and transported to the Brooklyn Center Police Department where he was read the breath test advisory.
The defendant agreed to submit to a breath test, which revealed an alcohol concentration of.16 at 2:10 A.M. A record check revealed that the defendant was previously convicted of DWI for an offense from 4/06/18 (sentenced on 12/10/18).
