At 1:31 AM on November 22, 2025, officers came upon a Toyota Camry bearing Minnesota license plates TBS629 on Cypress Street near Fifth Street, St. Paul, Ramsey County. The Camry was running with its keys in the ignition, and its driver and passenger were both slumped over. Officers saw drug paraphernalia in the center console. Officers knocked and woke the occupants. The driver, LAVONNE EUGENE BURGIN [DOB REDACTED], was disoriented and dazed. Upon realizing he was dealing with officers Burgin reached into his pockets and threw a plastic bag on to the floorboard.
Officers eventually got Burgin to exit the Camry. Officers recovered the plastic bag that contained a white powder. Burgin was arrested and transported to jail. Burgin’s head sweated profusely while in a holding cell. Officers obtained a search warrant to collect a blood or urine sample from Burgin. Burgin was informed that refusal to cooperate with the warrant was a crime. Burgin said, “No,” when asked to provide a blood sample. Burgin refused to answer when asked to provide a urine sample. The contents of the bag Burgin dropped tested positive for the presence of fentanyl and weighed 0.99 grams.
On October 28, 2025, Burgin’s driver’s license was revoked pursuant to an incident where he was a slumper in the driver’s seat of a vehicle. Burgin was charged with gross misdemeanor test refusal and felony VOCSL 5 from that incident in Ramsey County District Court file ••-CR-••-••••. Burgin has 9 prior felony convictions dating back to 2000.
