The Complainant having reviewed the applicable reports believes the following facts to be true: On November 1, 2025, at 4:34 PM, officers received a report from a driver, who is fully identified in police reports and referred to herein as A.M. R., that another person was following them in a Toyota Highlander (MN LIC RRV252). A.M. R. Stated that the other driver was intoxicated. A.M. R. Pulled into the Holiday Gas Station at [ADDRESS REDACTED] in Saint Paul, Ramsey County. The other driver followed A.M. R. Into the gas station parking lot and eventually left.
Officers located the Highlander at Minnehaha Avenue and Etna Street and conducted a traffic stop. The driver was identified as Bobby Chai LEE [DOB REDACTED], the defendant herein. The defendant's eyes were bloodshot and there was an odor of alcohol. He admitted to having four beers. The defendant performed Standard Field Sobriety Tests, which further indicated impairment. There was distinct and sustained nystagmus in both eyes. He did not properly follow instructions and had difficulty balancing.
The defendant blew into a PBT on the scene, but it was not able to get a proper reading. The defendant was taken into custody and transported to the Ramsey County Law Enforcement Center. An officer read the Minnesota Breath Test Advisory to the defendant. He stated that he wanted to speak with an attorney in person. Officers told him that was not an option but that there were phone books available for him to use. The defendant did not call an attorney and asked officers if they could recommend an attorney to him.
After some time, the officer ended attorney time based on the defendant's inaction in calling an attorney. The officer asked if the defendant would take a breath test. The defendant stated that he would not take a breath test.
