On 01/01/2026, at approximately 0032 hours, an on-patrol Officer observed a vehicle near the intersection of Lake Drive and Victory Memorial Parkway in Robbinsdale, Hennepin County. The Officer observed the vehicle failed to stop at a stop sign and also observed the vehicle to have a nonfunctional front headlight. The Officer pursued the vehicle and observed it swerve from side to side. The Officer then conducted a traffic stop of the vehicle. The Officer approached the vehicle and made contact with the sole occupant and driver, identified as David Smith, [DOB REDACTED], Defendant herein.
The Officer observed Defendant to have bloodshot and watery eyes. The Officer asked Defendant how much he had to drink to which defendant replied, “too much.” The Officer then asked Defendant to exit the vehicle at which point the Officer could smell the odor of alcohol emanating from Defendant. The Officer then had Defendant complete a standardized field sobriety test and the Officer observed enough cues to ask Defendant to take a preliminary breath test. The Defendant provided a breath sample which registered a BAC of.166. Defendant was then arrested for DWI and transported to the Robbinsdale Police Department.
Defendant read the breath test advisory and refused to provide a breath sample. Defendant has been previously convicted of a felony DWI in ••-CR-••-••••. Defendant is in custody.
