07/01/2005, who indicated that his ribs hurt and he didn’t know where he was, and that he did not see the stop sign. While speaking to GARZA, Trooper Argabright noticed that his eyes were bloodshot. GARZA further stated, “I know I missed the stop sign,” and that he didn’t see it and tried stopping but could not slowdown in time and when he tried to turn he got t-boned. GARZA also indicated that he had smoked marijuana two hours prior to the crash. A witness, identified as Alyssa Riebe, approached Trooper Argabright as he was walking away from the damaged vehicles and told him that the Dodge Journey was heading eastbound on 120th Ave SE and didn’t stop at the stop sign.

In speaking with the driver of the Chevy Traverse, Justine Hutchins, she indicated to Trooper Argabright that she had not consumed alcohol or drugs prior to driving and she was not distracted by anything. Justine Hutchins also informed Trooper Argabright that her mother, Jody Hutchins was in the front passenger seat and she was still in the vehicle. A blood sample was collected from GARZA pursuant to a search warrant, and submitted to the BCA for analysis. The analysis of GARZA’s blood sample resulted in the presence of delta-9-tetrahydrocannabinol (delta-9-THC), 11-hydroxy-delta-9-tetrahydrocannabinol (hydroxy-THC) an active metabolite of delta-9-THC, and 11-nor-9-carboxy-delta-9-tetrahydrocannabinol (carboxy-THC), an inactive metabolite of delta-9-THC. On 6/30/2025, Trooper Argabright spoke to Justine Hutchins who informed him that her mother, Jody Hutchins, had 7 rib fractures, a bruised lung, a small laceration to her liver and a fractured sternum as a result of the collision.
