The Complainant having reviewed the applicable reports believes the following facts to be true: On January 2, 2025, at 12:10 AM, a trooper was on patrol in the area of Kellogg Boulevard and Marion Avenue in Saint Paul Ramsey County. The trooper observed a vehicle driving between two lanes and weaving over lane lines multiple times. The vehicle was speeding 43 miles per hour in a 25 mile per hour zone. The trooper conducted a traffic stop and identified the driver as Kakada KHIEV [DOB REDACTED], the defendant herein.
The defendant stated he knew he was going fast and that his tires were slipping. There was an overwhelming odor of alcohol. The defendant's eyes were bloodshot and watery and his speech was slurred. The defendant initially refused to complete Standard Field Sobriety Tests but changed his mind when the trooper told him he was going to be placed under arrest for DWI. The Horizontal Gaze Nystagmus Test indicated impairment. Due to the cold weather no further field sobriety tests were completed. A PBT showed a BAC of.104. The defendant was taken into custody and transported to the Ramsey County Law Enforcement Center.
The trooper read the Minnesota Breath Test Advisory. The defendant consulted with an attorney and agreed to provide a breath sample. The DMT showed a BAC of.08 at 1:28 AM. The defendant has three prior DWI convictions outside of ten years.
