On or about December 9, 2025, Anoka Police Department officers received a delayed report of criminal sexual conduct. Detectives with the Anoka County Sheriff’s Office later interviewed the adult victim, [NAME REDACTED] is known to the State. She reported that on or about August 10, 2025, until on or about August 11, 2025, her then boyfriend, ANDREW DAY JONATHAN [DOB REDACTED] (“Defendant” hereinafter), sexually assaulted her at her residence in the city of Anoka, Anoka County, Minnesota. The victim [NAME REDACTED] in 2023, and they began dating in April.
They separated in August 2024 but reconciled after she learned she was pregnant. Defendant moved into the victim’s family home in January 2025. The victim ended the relationship again following Defendant’s DWI arrest in October 2025, but they later reconciled. The victim [NAME REDACTED] incidents of non-consensual sexual conduct throughout their relationship. She stated that Defendant pressured her into oral sex early in the relationship. Although he apologized when confronted, the behavior continued.
She reported that Defendant was never physically assaultive but used his size and persistence to overcome her refusals. Regarding the August 10, 2025, incident, the victim [NAME REDACTED] had returned from Army training that day, and she observed his phone near the Anoka County Fairgrounds and located him drinking in a parking lot. The victim [NAME REDACTED] from his truck to prevent further drinking. She returned home, and Defendant arrived about an hour later, intoxicated. The victim [NAME REDACTED] in her bed with their infant in a nearby bassinet when Defendant became aggressive, touching her vaginal area over her underwear despite her repeatedly moving his hand away.
She told him she did not want to engage in sexual activity because he was not sober. Defendant accused her of being disrespectful and continued touching the victim. The victim attempted to go to sleep, and the Defendant began to undress and remove the victim’s underwear despite her saying no. The victim reported feeling trapped because her infant son was in the room and she did not want Defendant to get mad and take it out on their son. Defendant then began rubbing his penis between her legs before grabbing her shoulder and turning her onto her back.
The victim reported she gave up resisting and “accepted defeat.” She asked Defendant when the assault would end, and he stated, “you’ll take it for as long as I want you to, and you're gonna make me cum.” The victim reported she complied with Defendant’s demands because she felt she had no choice. The victim [NAME REDACTED] was penetrating her vagina with his penis, he stated: “I’m going to stick it in your ass.” The victim refused, telling Defendant, “I don’t want to do that.” Despite the victim [NAME REDACTED], no, Defendant retrieved a condom and lubricant and told the victim [NAME REDACTED] on her hands and knees and attempted anal penetration.
