On November 27, 2024, Minneapolis police officers met with adult female Victim [NAME REDACTED] incidents of sexual assault that occurred a few days earlier at her residence, located on the 5500 block of Aldrich Avenue South, in Minneapolis, Hennepin County, Minnesota. Victim reported her ex-boyfriend sexually assaulted her and identified him as EDUIN ESPINOZA-CARTUJANO [DOB REDACTED], hereinafter “Defendant.” Victim [NAME REDACTED] in a relationship for approximately five years and have a two year old child [NAME REDACTED]. Victim and Defendant broke up back in April 2024. Victim stated on the night of November 22, 2024, Defendant came to her residence with their child to pick up something for the child.
Victim stays in the basement of the house. When Defendant entered the house, he immediately started grabbing Victim’s torso and trying to pull her towards him, kissing her neck and face. Defendant told Victim, “You belong to me, you know you’re mine, I don’t care who you’re with, I own you.” Victim did not want to have sex with Defendant and went down to the basement. Defendant followed her to downstairs and started kissing her again. Defendant then pulled her sweatpants and underwear down. Victim pulled them back up but Defendant kept pulling them down.
Victim did not verbally say no because she was scared but believed Defendant knew she did not want to have sex. Defendant eventually pushed Victim down on the bed facedown. Victim tried to push Defendant off but Defendant pushed her back and the back of her head down on the bed. Defendant then penetrated Victim’s vagina with his penis. Victim told Defendant to stop and that their son was in the room but Defendant continued to engage in sexual intercourse with Victim [NAME REDACTED]. Afterwards, Defendant pulled Victim’s head towards his penis and penetrated her mouth with his penis.
Defendant left a short time later. Victim stated a similar incident occurred a few days later, on November 25, 2024. Defendant showed up at her residence unannounced. Defendant came into the house and started grabbing and kissing her. Victim [NAME REDACTED] told Defendant that she did not want that. Defendant then grabbed her, turned her around and pulled both her arms behind her back. Victim [NAME REDACTED] at Defendant to stop. Victim [NAME REDACTED] went down to the basement again with their son.
Defendant started pulling her pants down but Victim [NAME REDACTED]. Victim tried to tell Defendant she did not want to be pregnant but Defendant stated they could have anal sex. Victim [NAME REDACTED] was crying and told him no. Their son was in the room watching TV at the time. Victim stated she submitted because she was afraid of Defendant and wanted him to leave. Defendant then rubbed his penis on her vagina and anus but did not penetrate her. Victim [NAME REDACTED] on Defendant with his penis penetrating her mouth until Defendant ejaculated.
