On December 24, 2025, at approximately 10:04 PM, Officer Peterson with the Rochester Police Department was on patrol in Southeast Rochester, Olmsted County, Minnesota. She was in the parking lot of a gas station when she observed a vehicle owned by ADRIAN LAMAR FOUNTAIN, [DOB REDACTED], who had a revoked driving status. Officer Peterson conducted a traffic stop near the intersection of Highway 14 and 30th Avenue Southeast and made contact with the driver, Fountain. Officer Peterson asked for Fountain’s insurance.
While he was looking in his glove box, Officer Peterson observed a fresh roll of tin foil. Fountain stated the foil was for cooking. Officer Peterson also observed a hollowed-out pen with burnt ends near the center console, which she knows is used for smoking illegal narcotics. During her conversation with Fountain, he was moving around and fidgeting. His pupils were constricted for the lighting conditions, and his speech was so slurred and rapid it was difficult for Officer Peterson to understand Fountain.
When asked, Fountain told Officer Peterson he had not used illegal narcotics in over a year. He also told her that he used methadone earlier that day. Officer Peterson asked Fountain to exit the vehicle to conduct Standardized Field Sobriety Tests (SFSTs). Fountain stated he had hip surgery in 2016, but he would attempt to complete SFSTs. Fountain was swaying and estimated the passage of 30 seconds in 17 seconds during the Modified Romberg SFST. During the Walk and Turn SFST, Fountain was not able to keep balance during the instructions, did not touch heel to toe, stepped off the line, stopped while walking, used his arms to balance, and did an incorrect turn.
Officer Peterson observed no clues during the Horizontal Gaze Nystagmus SFST, but Fountain was unable to remain still. Officer Peterson placed Fountain under arrest for suspected driving while impaired. Officer Peterson searched Fountain incident to arrest and located a bag of a white powdery substance. This substance later tested presumptive positive for fentanyl and weighed 4.5 grams with packaging. Officer Peterson transported Fountain to the Olmsted County Adult Detention Center (ADC). At the ADC, Fountain fell asleep multiple times while Officer Peterson was drafting a search warrant for his blood or urine.
Fountain provided a urine sample at approximately 11:33 PM.
