On September 17, 2025, the Department of Human Services (DHS) notified Det. Walski of the Austin Police Department that a twelve-year-old child (Victim A, DOB/081713) had given birth to a baby girl that day at Mayo Clinic-Austin, It was reported that Victim A and her mother (Witness 1) did not know she was pregnant and initially reported that they did not know who the father was. Det. Walski learned that Victim A lives with her mother and stepfather, MIGUEL SEBASTIAN DOMINGO, DOB/012164, the defendant herein, in the City of Austin, County of Mower.
On that day, at approximately 2:00 P.M., hospital staff then contacted law enforcement to report an unwanted male in the hospital. Staff reported that Victim A had just given birth, the defendant was outside the birth room, and it had been reported that he is the father of Victim A's baby. Det. Walski and other law enforcement officers went to the hospital. Walski contacted the defendant and confirmed that Victim A is his stepdaughter. When asked who the father of Victim A's baby is, the defendant avoided the question and stated that Victim A had a problem with him and that is why this is happening.
Walski asked the defendant if the baby was his. The defendant responded, "they told me so," but he did not know. Walski then asked the defendant if he and Victim A had sex. The defendant replied, "that's what she said, but I don't know." The defendant then admitted they had sex one time, but said it was a long time ago. Det. Walski asked the defendant if the DNA would show that he is the father. The defendant stated that he is 60 years old and has a problem and stated that he has high blood pressure.
Walski asked again if the baby was his. The defendant stated, "if it is, that's ok, I don't know what I will do." Det. Walski asked the defendant when the last time he and Victim A had sex and where. The defendant stated, "at home." The defendant admitted that he and Victim A had sex "like three times" and admitted he had sex with Victim A nine months prior. The defendant also stated that "I didn't make her scream, or ery, I didn't do anything." Det. Walski then contacted Witness 1 and Witness 2 (an adult male). Witness 1 stated that she did not know Victim A was pregnant.
She stated that she brought Victim A to the hospital because of a stomachache and was told she was going into labor. Witness 1 stated that the defendant is her ex-partner with whom she has a two-year-old child. She stated that the defendant still lives at the house with her and the children. Witness 1 stated that while at the hospital, Victim A said the defendant was the father. Witness 1 said that the defendant also admitted that he was the father of the baby. Witness 1 said Victim A also told her that the defendant threatened her and told Victim A not to tell Witness 1 anything or that she was pregnant.
