On January 17, 2026, at 01:38, Shakopee Police Officers were on patrol on County Road 21, Shakopee, Scott County, Minnesota, when the officer saw a yellow Chevy SUV fail to stop for the stop sign at Southbridge Pkwy and County Road 21. The officer stopped the vehicle. The driver was identified as Darryl Lamont Davis, [DOB REDACTED], hereinafter the Defendant. The officer saw the Defendant's eyes were bloodshot and watery. While speaking with the Defendant, the officer smelled the odor of a consumed alcoholic beverage coming from his breath.
The officer ran a record checked, which showed the Defendant's driver’s license status was canceled inimical to public safety (Canceled IPS). The officer had the Defendant exit the vehicle. When the Defendant exited the vehicle, the officer saw the Defendant had poor balance. The Defendant stated he knew he should not be driving. The officer had the Defendant take the Horizonal Gaze Nystagmus test, which he failed. Because of the weather no further tests were given. The Defendant took a preliminary breath test, which resulted in a reading of.147 BAC. The Defendant was arrested for DWI and CAD-IPS and taken to the Shakopee Police Department.
The officer read the breath test advisory to the Defendant. The Defendant wished to call an attorney. The Defendant made a call to an attorney and finished his call at 02:32. The Defendant agreed to take the DMT breath test; however, the Defendant continued to spit up and vomit. Due to not being able to complete an adequate observation period, the officer applied for a search warrant to obtain a sample of the Defendant's blood or urine. The search warrant was signed by Judge Fallon at 03:29 hours.
The Defendant was taken to St. Francis Hospital. The Defendant agreed to give a blood sample. A blood sample was taken from the Defendant by a medical technician using a BCA collection kit at 04:14. The Defendant was taken to the Scott County Jail. A check of state records showed that the Defendant had a prior felony DWI conviction.
