On November 5, 2025, at approximately 7:30 PM, Trooper Vang of the Minnesota State Patrol was dispatched to respond to a driving complaint reporting a gray Ford that was seen nearly striking multiple other vehicles before it ran itself off the road and had wires sparking from below the vehicle, in the area of Highway 10 and Hanson Boulevard in the city of Blaine, County of Anoka, State of Minnesota. The trooper located the vehicle parked in the parking lot of the Red Lobster located on University Avenue in Blaine with the front passenger wheel on the curb.
The trooper approached the stopped vehicle and later fully identified the driver to be FRANKLIN GIOVANNY AUQUI SUCUZHANAY [DOB REDACTED], "Defendant" herein. The trooper smelled a strong odor of an alcoholic beverage emitting from Defendant's person and observed Defendant's eyes to be bloodshot and watery and he was unsteady on his feet. Through the use of the language line, the trooper attempted to administer standardized field sobriety tests. Defendant did not follow instructions for the HGN and continued to move his head and not follow the stimulus with his eyes.
Defendant provided a sample for a preliminary breath test, which indicated he had a 0.177 BAC. Defendant was placed under arrest and transported to the Anoka County Jail. Defendant was read the Minnesota Breath Test Advisory in Spanish and was provided an opportunity to contact an attorney. Defendant subsequently agreed to submit to an evidentiary breath test. Defendant was administered a Data Master Transportable breath test (DMT) at approximately 9:37 PM, the final reading of which was a 0.18 BAC. A review of Defendant's records shows no prior qualifying impaired driving related convictions.
