On or about November 4, 2025, at approximately 4:02 PM, officers of the Mankato Police Department responded to a report of a male suspect, later identified to be KYLE DAVID BURGESS, [DOB REDACTED], the Defendant herein, sleeping in a vehicle located outside [ADDRESS REDACTED], City of Mankato, Blue Earth County, Minnesota. Prior to Mankato Officers arriving, the Blue Earth County Sheriff's Office arrived and located the vehicle. Officers were advised that Defendant had been in physical control of the vehicle with the keys in the ignition.
Defendant was seen sitting on the curb of the road near the vehicle. Defendant was noted to have bloodshot, watery eyes, an odor of a consumed alcoholic beverage, and slurred speech. Defendant stated he was waiting for his sister, who lived near where he parked, for about two hours prior to officer's arrival. Defendant stated he had only begun drinking until after he parked the vehicle. Defendant agreed to perform standardized field sobriety tests. Defendant showed several signs of impairment during the tests and, after conducted a preliminary breath test, Defendant's BAC was revealed to be 0.286. Defendant was placed under arrest and was transported to Blue Earth County Jail.
Upon arrival at the jail, Defendant was read the MN Breath Test Advisory, stated he understood, and consented to take the breath test. After an observation period elapsed, Defendant produced a breath sample with a BAC of 0.27. Defendant was transported to a detox center.
