Officers had to cut off Defendant’s backpack to place Defendant in handcuffs. While holding Defendant’s backpack, Officer LeFevere noticed that there was a heavy object inside. The object inside the backpack felt like a pistol based on the weight, shape, and hardness. Inside the backpack, Officer LeFevere located a loaded pistol with a round in the camber. The pistol was described as a Glock clone style ghost gun (no serial number) with an extended magazine designed to carry 33 rounds of 9mm ammunition.
There were approximately 26 rounds in the magazine. Officers read Defendant his Miranda warning. Defendant agreed to speak with Officers. Defendant admitted to not having a valid permit to carry the pistol in public and knew he was supposed to have a valid permit to carry a pistol in public. Defendant stated he carried the pistol for protection when he was in Minneapolis. Defendant stated he pretty much carries the pistol with him every time he goes to Minneapolis. Defendant stated he was at the Cub Foods in Uptown Minneapolis prior to coming to R. J.’s residence, where Defendant had been living.
Defendant kicked the side door in since all the doors to the residence were locked. At present, Defendant is in custody.
