On November 6, 2025 at approximately 1434 hours Officers Charlton and Dunford were patrolling in the City of Rochester, Minnesota in the area of 2nd Street NW and 11th Avenue NW when they observed a vehicle come to a stop at the stop sign at 2nd Street NW and 13th Avenue. The vehicle sat at the stop sign for several seconds with no turn signal activated, and then activated the turn signal while turning south onto 13th Avenue. Officers caught up to the vehicle and pulled next to it and Officer Charlton observed the driver who he suspected to be Moeun Mok and who he knew had a revoked driving status.
Officer Charlton also observed an object (necklace) hanging from the rear view mirror. He also observed that the rear seat passenger did not have their seat belt on. A traffic stop was performed as the vehicle pulled into McDonald's. Officer Dunford approached on the passenger side while Officer Charlton approached on the driver's side. The driver was MOEUN MOK, [DOB REDACTED], and Mok confirmed that he was revoked. While speaking with Mok Officer Charlton observed that his pupils were constricted, even though the sky was overcast and it was darker inside the vehicle.
Mok appeared agitated, and displayed droopy eyelids, rapid mumbling speech, facial muscle twitching, and body tremors. Officer Charlton observed what appeared to be the end of a makeshift pipe sticking out of Mok's left side jacket pocket. Officer Charlton also observed a plastic straw that was burned closed on one end tucked by the driver seat next to Mok's leg. Based upon training and experience Officer Charlton knew that plastic straws are often used in that way to either store illegal drugs or use them.
Officer Charlton removed the straw and Mok became very agitated about it and stated multiple times that there were no drugs in it. Mok denied alcohol use or prescription medication use, and stated that he last used meth or other illegal drugs 2 years prior. Officer Charlton had Mok exit the vehicle to do field sobriety tests. Mok then stated that he used a year and a half ago, then stated he used last month, and finally stated that he used Oxy, cocaine and marijuana 11 hours earlier. The HGN test yielded 2 clues of impairment, walk and turn test yielded 4 clues of impairment, and one leg stand 2 clues of impairment.
During the Modified Romberg test Officer Charlton observed swaying, body tremors, twitching facial muscles, and constricted pupils. Mok estimated 30 seconds in 30 seconds. Officer Charlton observed lack of convergence in both of Mok's eyes during lack of convergence testing. Officer Charlton, a Drug Recognition Evaluator, believed that Mok was under the influence of a controlled substance and unable to operate a motor vehicle safely, and Mok was placed under arrest. A search incident to arrest performed by Officer Dunford revealed that Mok had a makeshift pipe in his jacket pocket, and a plastic baggie in his right inside jacket pocket that contained a white crystalline substance that appeared to be methamphetamine.
