Cloud Correctional Facility in the City of St. Cloud, County of Sherburne, State of Minnesota. The defendant became upset when he was told he could not keep property bins on his bed. The defendant began throwing items from his cell and began damaging his light fixture. The Incident Command System was activated and staff responded. The defendant was placed in handcuffs and an escort to the segregation unit was begun. During the escort from the upper level of the cell unit the defendant began to resist staff at the top of the staircase, including attempting to push one of the corrections officers, CO ET down the stairs.
Corrections Officer ET ordered the defendant to stop forcing him to open stairway. Corrections Officer TB attempted to assist in restraining the defendant. The defendant lunged forward and drove his head violently into Corrections Officer TB's forehead. The defendant was then placed on the ground and secured in a full body "WRAP" restraint and placed into segregation. CO TB was seen by prison medical staff and then was transported to be seen at the emergency room. He was determined to have a closed head injury and scalp hematoma.
Other corrections staff and medical staff observed a large hematoma on the right side of CO TB's forehead as a result of the defendant's assault. PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49, intentional failure to appear for duly scheduled court appearances may result in additional criminal charges, and in addition to any arrest warrant that may otherwise be issued by the Court.
