On May 20, 2025, Deputy Sufka of the Wright County Sheriff's Office responded to a restaurant in the City of Monticello, Wright County, Minnesota, regarding a sexual assault that occurred on May 17, 2025. Deputy Sufka met with an adult female, hereinafter Complainant, who reported the following: Complainant was a night shift waitress at the restaurant; Complainant was working the early morning hours of May 17, 2025; A regular overnight customer, Benjamin Anthony Montroy [DOB REDACTED], hereinafter Defendant, came to the restaurant at approximately 2:15 A.M., along with some other regular customers; Complainant knew Defendant well and went to give Defendant a hug; Defendant appeared to be intoxicated, lost his balance, and caused Complainant's back to be against a wall; Defendant tried to kiss the side of Complainant's neck; Complainant pushed Defendant away and Defendant stopped trying to kiss Complainant; Defendant proceeded to a table with his group; Approximately thirty minutes later, Complainant went to Defendant's table to take the food order for the group; Complainant sat in a chair to the right of Defendant while taking the order; Defendant grabbed Complainant's left knee, quickly moved his hand up to her inner thigh, and grabbed Complainant's vagina; As Defendant grabbed Complainant's vagina, Complainant felt two of Defendant's fingers enter her vagina; Complainant was wearing thin pants, underwear, and an apron; Complainant quickly stood up and told Defendant, "you can't do that;" Complainant walked to the other side of the table to complete the order; Defendant moved very fast when he grabbed Complainant's vagina; In the early hours of May 19, 2025, Defendant and Complainant exchanged messages on Snap Chat in which Complainant noted Defendant's sexual assault.
Deputy Sufka spoke with the restaurant manager and learned that there would be video footage from the foyer area, but not the dining area. Deputy Sufka spoke with an adult male, identified as L. G. Who was part of Defendant's group at the restaurant. L. G. Stated that Complainant was sitting between Defendant and a female, identified as T. J., while taking the food order. Complainant suddenly tensed up, arched her back, became shaky, stood up, and went to the other side of the table. The pitch of Complainant's voice changed as well.
The next day, Complainant told L. G. That Defendant sexually assaulted Complainant. Deputy Sufka tried to reach T. J. By telephone, but T. J. Did not answer the call or return Deputy Sufka's voicemail. T. J eventually provided a statement to an attorney for Defendant. T. J. Reported that she did not observe Complainant to be uncomfortable or exhibit any remarkable behavior. Detective Bautch of the Wright County Sheriff's Office was assigned to investigate further. Video footage from the restaurant was obtained and showed Defendant in what appeared to be an intoxicated state.
