On or about November 4, 2025, at approximately 6:08 P.M., Sgt. Nagel of the Hutchinson Police Department was dispatched to S. Grade Rd. And Merril St. Crosswalk for a hit and run, which occurred next to the Cashwise in Hutchinson, MN. Upon arrival, law enforcement found the person who was hit with the car, “Victim” hereinafter, who was laying on the street near the south curb in the crosswalk on S. Grade Rd. Two individuals near in the incident stated they saw the crash. The suspect vehicle was not on scene.
Witness 1 stated she saw the crash and saw Victim [NAME REDACTED] at the time the vehicle struck him. Witness 2 also stated she saw the suspect vehicle hit Victim, [NAME REDACTED] in the crosswalk. The crosswalk warning light was not activated. She said the victim [NAME REDACTED], about three feet from the end of it. The SUV in front of her looked to have braked and swerved at the last minute. The SUV hit the victim with the front passenger side corner. The SUV took a right at the roundabout and went into the Cashwise parking lot.
Video surveillance showed the SUV was a maroon color. Video sureveillance showed the victim did not activate the flashing lights at the crosswalk. The suspect SUV can be seen entering the fram where it looks to be about at the intersection of South Grade Rd. And Church Street. The middle of this intersection is about 325 feet away from the crosswalk. Victim’s left hand was raised to the side of his head as if he was talking on a cell phone. Victim [NAME REDACTED] once he got about halfway across the crosswalk, and then slowed back donw to a walking pace.
The SUV approached the crosswalk and did not seem to slow down. The SUV does appear to brake immediately before hitting Victim, and an audible thud can be heard upon contact. Victim [NAME REDACTED] was walking home and was on the phone in the crosswalk. He did not activate the crosswalk warning lights. As he was crossing, he noticed a vehicle coming from approximately one and half blocks away. He was then hit by the vehicle. Victim [NAME REDACTED] on his right elbow and a fracture in his knee. A vehicle antenna was found next to the crosswalk at the intersection of South Grade Rd. On November 6, 2025, at approximately 12:04 A.M., an anonymous caller stated a vehicle matching the description of the suspect vehicle was parked at the Seneca Food Coporation in Glencoe, MN, with damage to the front passenger side.
The vehicle was missing an antenna, and matched the description of the suspect vehicle. The vehicle had a dent on the front passenger side fender directly behind the headlight. The passenger side mirror was damaged and hanging from the vehicle. The registered owner was JUAN SANTOS DIAZ, [DOB REDACTED], “Defendant” hereinafter. Defendant was currently at work. Based on Defendant’s home address, a likely route he would take to get home from Glencoe would be to drive east on the South Grade Rd. SW and then drive south on Highway 15. Defendant’s shift was at 7:00 P.M., and the suspect vehicle would also likely take the same route the opposite direction to get to Seneca Foods by 7:00 P.M. A third person was interviewed, Witness 3. Witness 3 stated she did not know what was going on, but 2 ••-CR-••-•••• Filed in District Court State of Minnesota 11/6/2025 Defendant had keys to Defendant’s vehicle.
