Officers recovered a Swann HD Network Video Recorder from the residence. 3 62-CR-26-2617 Filed in District Court State of Minnesota 4/16/2026 Garay declined a custodial statement. Video from Garay’s residence on March 20, 2026 showed Garay wearing a blue sweatshirt with darker stripes down the sleeves around 4:46 PM. The sweatshirt matches the one worn by the man casing the Cherry Pit parking lot before the shooting. Video also showed Garay got into a green Chevrolet bearing Minnesota license plates LRL818 at his address at around 10:30 PM on March 20, 2026. Officers towed the Cadillac DTS. Officers searched the Cadillac pursuant to a warrant.
Officers recovered a blue hooded sweatshirt similar to the sweatshirt worn by the man casing the Cherry Pit parking lot before the shooting. On April 15, 2026, Verizon finally returned records requested by law enforcement. The records show Garay’s Samsung phone was in the Cherry Pit parking lot at the same time the man in the blue sweatshirt with the stripes searched for cars. The records show that at 12:21 AM on March 21, 2026, Garay’s phone was in the area of the shooting location. The phone records also placed Garay’s phone in the same area where license plate data placed LRL818 on the evening of March 20, 2026 before the shooting.
Garay has prior felony convictions for VOCSL 2, felon in possession of a firearm, and burglary in the first degree. The drug and burglary convictions make Garay ineligible to possess firearms or ammunition. Each of Garay’s convictions is a violent crime pursuant to Minnesota Statute 609.1095, subd. 1(d).
