Complainant is Minnesota State Patrol Trooper John Thao. Complainant states that on June 8, 2025, at approximately 5:23pm, troopers responded to a motor vehicle crash in the area of I-94 in the city of Maple Grove, Hennepin County, Minnesota. Dispatch advised that a party reported that a vehicle had crashed into a guardrail and now was stopped on the right-hand shoulder of the interstate. Upon arrival, troopers observed a grey sedan with heavy rear end damage. The driver side rear tire could be seen bent inward with the bottom protruding further than the top.
As troopers approached the vehicle, they observed the driver of the vehicle hastily throw an unknown object in the rear seat. Toopers noted the driver was the sole occupant of the vehicle. While making contact with the driver, later identified as JOSUE BASURTO [DOB REDACTED], troopers detected a moderate odor of alcohol coming from inside the vehicle, as well as BASURTO had watery eyes. BASURTO advised that he was coming from Coon Rapids and was trying to overpass another vehicle and got brake-checked, causing him to brake and slide.
Troopers requested BASURTO to exit the vehicle to make sure he was safe to drive. While BASURTO exited, troopers observed that he stumbled walking to the rear of his vehicle. When speaking with BASURTO face to face, troopers continued to smell the odof of alcoholic beverage coming from his person. Troopers requested BASURTO participate in Standardized Field Sobriety Tests (SFSTs), and he agreed. During HGN, troopers observed BASURTO had lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and onset of nystagmus prior to 45 degrees in both eyes.
During the one leg stand, BASURTO swayed, put his foot down, and used his arms for balance. BASURTO also displayed six indicators of impairment on the walk and turn test, including stepping off the line, losing balance during instructions, and taking the wrong number of steps. BASURTO agreed to give a PBT sample and blew a.18 BAC. BASURTO was placed under arrest and was transported to the Hennepin County Jail where he was read a Breath Test Advisory. BASURTO agreed to give a DMT sample and provided a breath sample of.16 BAC at 6:56pm, within two hours of his driving conduct.
