On December 7, 2025, at approximately 1:34 A.M., Trooper Gruver was dispatched to a driving complaint. Multiple callers reported a dark colored SUV driving the wrong way on a one-way highway at highway speeds. Trooper Gruver responded emergent and located the vehicle, still driving the wrong way, on Highway 10 in Clay County, MN. Trooper Gruver had his emergency lights and sirens on and attempted to block the path of the vehicle. The vehicle did not stop, and Trooper Gruver had to move his vehicle to avoid being hit head on by the driver.
Another squad was present in the area and the vehicle drove past that squad car that also had its lights and sirens on. Again, Trooper Gruver tried to get in front of the vehicle to make it stop and the vehicle went around Trooper Gruver by driving into the ditch. The vehicle continued driving. The vehicle eventually stopped once Trooper Gruver got in front of it for a third time. The driver of the vehicle was identified as DESTINY NICOLE WEAVER, [DOB REDACTED], hereinafter "Defendant". Defendant admitted to having had a few drinks prior to driving.
Trooper Gruver observed Defendant's eyes to be bloodshot and watery. He also observed her speech to be slurred. Trooper Gruver administered the horizontal gaze nystagmus test to Defendant and Defendant's performance showed 6 out of 6 clues of impairment. Other tests were not administered due to Defendant only wearing a thin sweater and the temperature being below zero degrees. A preliminary breath test showed that Defendant's BAC was.15. Defendant was arrested and brought to the Clay County Jail.
At the jail, she was read the implied consent advisory and agreed to take a breath test. The test was administered at 2:47 A.M., and showed a BAC of.17. Defendant was previously convicted of DWI in 2023 in Becker County file 03-CR-22-783; Defendant also has an implied consent license revocation on her record from July 22, 2020. Defendant was previously charged with DWI and Fleeing in a motor vehicle related to the 2020 license revocation. The charges were ultimately dismissed after the officer left employment with Dilworth PD and was unable to testify at trial.
