The Complainant having reviewed the applicable reports believes the following facts to be true: On November 13, 2025, at 9:42 PM, an officer was on patrol on Como Avenue near Eustis Street in Saint Paul, Ramsey County. The officer observed a Chevrolet Suburban (MN LIC EJT670) make a wide right turn and drive over the solid yellow line on Eustis Street. The officer conducted a traffic stop and identified the driver as Luke James MATSCHINA [DOB REDACTED], the defendant herein. There was an odor of alcohol on the defendant's breath, and his eyes were bloodshot and watery.
The defendant stated he had one whiskey sour prior to driving. He also stated he was coming from Station 280 on Como, a sports bar. A PBT showed a BAC of.136. The defendant performed Standard Field Sobriety Tests, which further indicated impairment. Nystagmus was present at maximum deviation in both eyes, and nystagmus began prior to 45 degrees in both eyes. The defendant had some difficulty maintaining his balance. The defendant was placed under arrest. He informed the officer that there was a firearm in his vehicle.
The officer found a gun case sitting in the backseat, which contained a shotgun. The defendant was transported to the Ramsey County Law Enforcement Center. The officer read the Minnesota Breath Test Advisory to the defendant, and he agreed to provide a breath sample. The DMT showed a BAC of.15 at 11:18 PM. The defendant has a prior conviction for CVO - Under the Influence of Alcohol from March 26, 2018 (court file 82-CR-17-2658). He also has a prior DWI conviction outside of ten years, from 2012.
