On December 17, 2025, law enforcement had contact with T. N., fully identified in police reports, regarding an unrelated matter. At that time, T. N. Reported a sexual assault that occurred between November 25, 2025 and November 26, 2025, in the City of St. Cloud, County of Stearns, State of Minnesota. T. N. Reported she was at the residence with Devone Waylen Johnson, [DOB REDACTED], defendant herein. T. N. Reported she went to bed. Defendant started to kiss her. T. N. Told defendant she did not want to have sex.
Defendant then forced himself on top of T. N. And would not get off. Defendant penetrated T. N.'s vagina. During this, T. N. Was crying and begging defendant to get off of her. T. N. Stated she was trying to get defendant off of her. Defendant grabbed and squeezed her arms while pinning her down on the bed, which T. N. Stated caused pain. While trying to wiggle out of underneath defendant, defendant's hip pressed into T. N.'s leg causing pain. While sexually assaulting her, defendant kept telling T. N. To tell him she enjoys it and that she loves him.
T. N. Reported she would not say that and all she would tell him is no. When defendant stopped he started asking "did I rape you?" T. N. Reported she told defendant straight up that she did not want to have sex and she asked him why he would think that she wanted to have sex with him when she told him no, was begging him to stop, and crying. Law enforcement spoke to P. T., fully identified in police reports, who stated T. N. Came to her residence on Thanksgiving. P. T. Asked where defendant was and T. N. Told P. T. She needed to talk.
T. N. Was crying. T. N. Told P. T. She separated from defendant and defendant followed her. T. N. Told P. T. Defendant took advantage of her and that she tried to fight back. P. T. Called defendant and invited him over to the house to talk about what happened. Defendant admitted he did it. P. T. Told law enforcement defendant said she (T. N.) refused him and he decided to use the time to do what he did. Defendant apologized. P. T. Said to defendant that he was wrong, that he raped T. N. Defendant replied to her "yes" and that he was sorry.
Law enforcement spoke to C. S., fully identified in police reports. C. S. Reported T. N. Told her that she had gone to sleep and defendant raped her. Law enforcement spoke to E. D., fully identified in police reports. E. D. Reported that T. N. Told her that defendant forced himself on T. N. E. D. Reported T. N. And defendant had broken up. T. N. Told E. D. That she told defendant they were not going to do anything but defendant forced himself on her. E. D. Described T. N. As distraught when telling her what happened.
Defendant denied having sex on Thanksgiving or the day before. Defendant stated he only ever had consensual sex with T. N. It is believed that defendant may be residing in Louisiana at this time. The State has safety concerns given the nature of the charge. Additionally, this offense carries a presumptive prison commit. As such, the State is requesting a warrant. Complainant has reason to believe and does believe that all of the above information is true and correct. The above facts constitute your complainant's basis for believing that the above-named defendant, from on or about the 25th day of November, 2025, to the 26th day of November, in the City of St. Cloud, County of Stearns, State of Minnesota, committed the offense(s) described herein.
