On September 28, 2025, at approximately 3:33 P.M., Austin Police Department officers were dispatched to a residence in the 400 block of 310 Avenue NW in the City of Austin, County of Mower, for a report of a sexual assault. Dispatch advised officers that the victim and suspect were still at the residence. Officer Schuweiler arrived at the residence and spoke with Victim A (a 17-year-old female). Victim A stated she was unsure the exact date of the assault but knew it occurred on the same night as the Canelo v. Crawford boxing match, which was later determined to be September 13, 2025. Victim A told Officer Schuweiler that EVAN DANIEL VASQUEZ-AGUILAR, [DOB redacted], hereinafter the defendant, told her that they were going to drink and watch the fight at his friend's house, Victim A stated she told the defendant that if he could pick her up, she would go with him.
Victim A said it was around 10:00 or 11:00 P.M. Victim A said she was around family and friends, felt safe, so allowed herself to "get drunk, really drunk." Victim A said they were in a garage that belonged to the defendant's friend, and she was drinking Tequila shots directly from the bottle. Victim A was talking with the defendant and crying at one point, and then she blacked out. Victim A said she woke up in the middle of "doing it," which Officer Schuweiler asked if "doing it" meant the defendant was raping her, and Victim A said "yeah." Victim A said that what the defendant did to her was not consensual.
Officer Schuweiler asked Victim A what happened when she woke up, and Victim A said she was on her stomach, and the defendant was penetrating her vagina with his penis. Victim A said she knew it was the defendant because she saw his face. Victim A said it occurred in the defendant's bedroom; she was positioned in a way that the defendant could penetrate her while he was standing, and she was completely nude as was the defendant When asked if she could say anything, and she shook her head "no" because she was intoxicated.
Victim A said she blacked out again, woke up, and now was on her back. Victim A said the defendant did something with his mouth on her genital area. Victim A could not recall how long the assault lasted, and she woke up in the detendant's bedroom where the assault occurred. The defendant gave her a pair of boxers, pajama pants, and a sweatshirt to wear as he had already gathered them up; Victim A took her clothes home with her. Victim A said she recalled the defendant telling he: she told him she did not have anyone to "do tt" with which is why it happened.
Officer Schuweiler collected the pajama pants Victim A wore home after the assault. Officer Schuweiler spoke with Victim A's oldest brother, Witness (an adult male), Witness I said that a friend of Victim A's told him that the assault occurred. Witness 1 said this is when they asked Victim A about the assault. Witness I said he used his phone to video a confrontation with the defendant, and Witness told Officer Schuweiler he has video of the defendant admitting to the sexual assault of Victim A and agreed to provide the video to law enforcement.
