Your complainant is employed by the Columbia Heights Police Department. In that capacity, complainant has reviewed official reports and has learned substantially the following: On November 8, 2025, at approximately 9:51 P.M., Officer Alvarez observed a vehicle with a non‐functioning head light driving in the 4500 block of Central Avenue NE, in the City of Hilltop, County of Anoka, State of Minnesota. Officer Alvarez stopped the vehicle and observed there were three occupants along with multiple open alcoholic beverages throughout the vehicle.
Officer Alvarez made contact with the driver, identified as Darwin Mauricio Guaillas Saca, [DOB REDACTED], the defendant herein. Officer Alvarez observed that the defendant had an odor of alcohol and bloodshot, watery eyes. The defendant agreed to perform field sobriety tests, including the horizontal gaze nystagmus test, the walk and turn test, and the one leg stand test. In the opinion of Officer Alvarez, the defendant performed poorly on the field sobriety tests and showed multiple clues of impairment.
The defendant agreed to submit to a preliminary breath test which showed a 0.233 BAC. The defendant was placed under arrest for driving under the influence and was read the Minnesota Breath Test Advisory. The defendant declined an opportunity to consult with an attorney. The defendant agreed to submit to a breath test and Officer Boskovic administered the DataMaster Test which revealed a BAC of 0.20 at approximately 10:57 pm. A record check through the Department of Public Safety, Driver and Vehicle Services Division, confirmed that the defendant has a prior conviction for DWI from 6/23/2025 in Anoka County court file 02‐CR‐25‐1117.
