On January 13, 2026, at approximately 4:29 A.M., St. Cloud Police Department was dispatched to an apartment complex located on the 400 block of 8th Avenue North, in the City of St. Cloud, County of Stearns, State of Minnesota, on a report of a domestic assault. Through investigation, officers learned that the victim [NAME REDACTED]S., adult female fully identified in police reports, had been assaulted by Marcus Demar Smith Sr., [DOB REDACTED], the defendant herein. The defendant and C. M. S. Are family or household members.
Officer Hernandez arrived at the residence and made contact with C. M. S. Officer Hernandez observed C. M. S.'s voice sounded raspy. Officer Hernandez also observed C. M. S.'s cheeks had pinpointed red spots that appeared to be petechiae. C. M. S.'s neck was red with bruises and marks. C. M. S. Explained that she came to the residence after work around 3:30 A.M. C. M. S. Explained she took a shower around 4 A.M. And the defendant became upset and asked her why she was taking a shower. C. M. S. Explained she exited the shower and started to get dressed.
C. M. S. Reported the defendant grabbed her by her collar and threw her to the ground. When she was on the floor, the defendant got on top of C. M. S., placed both hands around her neck and choked her. C. M. S. Stated the defendant said to her "b**** why are you taking a shower?" while he was strangling her. C. M. S. Explained this lasted approximately fifteen seconds, she had difficulty breathing and felt like she was going to pass out. C. M. S. Reported the defendant eventually stopped choking her and picked her up and threw her onto the bed.
C. M. S. Explained the defendant was grabbing her collar and shaking her. C. M. S. Stated the defendant threw her towards the apartment door and told her to leave. C. M. S. Stated the defendant had strangled her in the past. Complainant has reason to believe and does believe that all of the above information is true and correct. The above facts constitute your complainant's basis for believing that the above-named defendant on or about the 13th day of January 2026, in the, City of St. Cloud, County of Stearns, State of Minnesota, committed the offense(s) described herein.
