On January 18, 2026, at approximately 8:50 P.M., Trooper Allen with the Minnesota State Patrol was driving on 54th Avenue North towards Veterans Drive in Waite Park, when he approached a pickup truck waiting for the traffic light to turn green bearing MN license plate ZNX-175. Trooper Allen followed the pickup through the intersection and noticed the pickup change lanes without signaling. Trooper Allen then watched as the driver of the pickup truck bounced the truck off the curb and observed snow go flying up when the truck drove onto the shoulder.
Trooper Allen initiated a traffic stop on County Road 134 in the City of St. Cloud, County of Stearns, State of Minnesota. Trooper Allen made contact with the driver, later fully identified as Randall Anton Rathbun, [DOB REDACTED], the defendant herein. The defendant could not roll down the window because it was frozen and tried to open the door and struggled with that as well. The defendant put the vehicle in park and then was able to open the door. Trooper Allen realized the defendant was struggling to open the door because he was so impaired.
The defendant's words were slow, deliberate and very slurred when he was talking to Trooper Allen. When asked for his driver's license, the defendant stated "nope". The defendant kept saying he wanted to call his wife and when asked why, he stated "because I'm going to prison; because I've done this before. I'm not, this isn't new." It was clear to Trooper Allen the defendant was heavily impaired due to slurred speech, overwhelming odor of alcohol and his fine motor skills were slow. The defendant stated he had a "few drinks". The defendant refused to do field sobriety testing and would not provide a preliminary breath test.
Trooper Allen had the defendant stop out of the vehicle and placed him under arrest. The defendant was transported to the Stearns County Jail where he was read the breath test advisory. The defendant did not want to speak with an attorney and refused to provide a breath test and stated "I don't want to" at 9:52 P.M. There are additional aggravating factors present, to-wit: the defendant was previously convicted of a felony DWI offense on March 27, 2018, in McLeod County Court file number 43-CR-18-13. The defendant was also previously convicted of a felony DWI offense on May 31, 2017, in Benton County Court file number ••-CR-••-••••. Complainant has reason to believe and does believe that all of the above information is true and correct.
The above facts constitute your complainant's basis for believing that the above-named defendant, on or about the 18th day of January, 2026 in the City of St. Cloud, County of Stearns, State of Minnesota, committed the offenses described herein.
