An undercover profile (hereinafter "UC") was created utilizing photographs of a young-looking female and the name “Shelby”. On July 24, 2025, the UC profile received a message from an individual, later identified as BRIAN RICHARD KRUEGER, [DOB REDACTED], the defendant herein, stating “Very cute girl!”. When the UC responded, the defendant stated, “You look young”. The UC responded that she was 15 years-old and the defendant stated “Holy s***, I’m 45”. The defendant later moved from communication on the web-based application to texting the UC. While texting, the UC reiterated several times that she was 15 and the defendant commented on the age difference, saying things including “Does it excite you that I’m 30 years older than you”; “How do you think that will feel in your 15 year old pussy”; “If you were 18, we could date and not have to be a secret”; “You know that it’s wrong that I look at you and think what I do, right?. Cause of your age”; “Honey, you are only 15”; “How does it make you feel having a bf that is 3 times your age?” On July 24, 2025, after being told the UC's age, the defendant sent the UC the following messages: “I would love to take that bikini top off and kiss your boobs”; “Would you f*** me if you had the chance?”; “Sucking cock?. Like it?”; “Your pussy licked??. Gonna have to try that”; “Can I see more of you without clothes on?” On July 25, 2025, the defendant sent the UC the following messages: “So I could cum in you as much as I want??”; “Where else would you want me to cum?”; “Then I can cum inside you”. On July 28, 2025, the defendant sent the UC the following messages: “So what would you want to do if I came there and got a room for a night?”; “I would definitely like to lick your pussy”; “Do you want my cock in you??”; “I only have one concern if we hooked up… That you would be too tight for me”. The defendant then sent the UC a photograph of a male (which he alleged to be himself) lying on a couch with an erect nude penis shown.
The defendant then messaged the UC “How do you think that will feel in your 15 year old pussy?”; “Where would you want me to cum?” On August 4, 2025, the defendant sent the UC the following messages: “Do your nipples get real hard when you're turned on?”; “Did you like having them sucked on?”; “Do you ever play with your pussy?” On August 5, 2025, the defendant sent the UC the following messages: “Not gonna lie. Woke and started thinking about you sucking my cock.”; “But do you want me to cum in your mouth?” On January 6, 2026, the defendant was arrested and after being read his Miranda rights, the defendant admitted to engaging in the above-communications with the UC. The defendant admitted to believing the UC was 15 years old at the time of the communications.
