LER said the driver transported him and two other individuals to the area where he was arrested. He remained inside the vehicle while the other individuals exited the car and walked away. He fell asleep and was awakened when the driver returned to the vehicle and told him police officers were in the area. Shortly after, the two other individuals returned to the vehicle. LER denied any involvement in the wire theft. During a search of LER, Officer Hall located a live round of ammunition (357 round) inside LER’s right 3 62-CR-26-1617 Filed in District Court State of Minnesota 3/10/2026 jacket pocket.
LER said the jacket belonged to a friend and the bullet was already inside the jacket. A wire cutter was found on LER. During a search of PEH, officers found a red screwdriver and three drill bits in his jacket pockets. After a Miranda advisory, PEH spoke to an officer. He said he did not know the name of the street he was on. He said he was dropping off a friend. After a Miranda advisory, VANG spoke to an officer. He said he did not know what street he was on. He said the other individuals in the car were lost.
They pulled over to sleep and wait until morning. VANG said his phone was dead and he could not use GPS. VANG said they were in the area picking up a friend, but he did not know the friend’s name. He later said the friend’s name was Paw, (unsure of spelling and last name). VANG also did not have an address for Paw, and said Paw had moved to several locations and they were trying to find him. The last location where they tried to pick up Paw was off of Cesar Chavez Street at a taco shop. Search warrants for samples of DNA from the suspects were obtained and DNA samples were collected.
The BCA Report on DNA testing reported Item 1 (swabbing from textured grip, cylinder ejections, hammer, and ejector rod), DNA profile was interpreted as mixture originating from four individuals. KU, VANG, and PAH are excluded from being a contributor to the mixture. The statistical calculation supports the inclusion of LER to the DNA mixture.
