CYour complainant is a police officer with the Eden Prairie Police Department. In that capacity, your complainant has read the police reports of Eden Prairie Police Officers Gordhamer and Streiff and believes the following to be true: On October 30, 2025, at approximately 7:08 P.M., Officer Gordhamer observed a blue Tesla displaying Minnesota registration STL283 turn onto eastbound Valley View Road from Mitchell Road in the City of Eden Prairie, County of Hennepin, State of Minnesota. Officer Gordhamer followed the Tesla onto Valley View Road.
Officer Gordhamer observed the vehicle drive over the center line. The driver of the Tesla was braking erratically, speeding up, then slowing down. The Tesla drove onto southbound Prairie Center Drive. As the Tesla approached the intersection of Prairie Center Drive and Technology drive, the traffic light turned yellow. The driver of the Tesla sped up, then stopped. When the semaphore turned green, the Tesla drove to the left of the traffic lane and drove very close to the curb. Officer Gordhamer activated his squad car’s emergency lights.
The driver of the Tesla continued driving and got into the right lane after Columbine Lane. The driver turned onto Commonwealth Drive and continue driving, failing to stop for Officer Gordhamer’s emergency lights. Officer Gordhamer used his squad car’s PA system and instructed the driver to park in a parking space. The driver of the Tesla parked in a parking space near Flagstone Assisted Living. The driver exited the Tesla. Officer Gordhamer instructed the driver that Officer Gordhamer was conducting a traffic stop and to get back into his vehicle.
Officer Gordhamer observed that the driver looked like a “zombie” and appeared to not understand what Officer Gordhamer was telling him. The driver stood by the driver’s door. Officer Gordhamer again instructed the driver to get back into the Tesla. The driver put his hands into the front of his sweatshirt pocket and failed to comply with Officer Gordhamer’s commands. Officer Gordhamer informed the driver he was being detained. Officer Gordhamer handcuffed the male and identified him as David Thomas Ross, [DOB REDACTED], hereinafter Defendant.
Officer Gordhamer observed that Defendant was sweaty to the touch, his eyes were watery and glassy, and his eyes were darting all over. Officer Gordhamer asked Defendant if he had consumed any alcohol. Defendant stated he does not drink alcohol. Officer Streiff, a Drug Recognition Expert, arrived on the scene. Officer Streiff observed that Defendant had a dazed look, appeared confused, and was sweating profusely. Officer Gordhamer and Officer Streiff walked over to Defendant’s vehicle and observed several nitrous oxide containers sitting on the passenger floor.
